Hello,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.
Thanks in advance for your help.

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

Fellow IVians,
We need to contact the campaigns of Senator Obama and Senator McCain and apprise them of our core issue. We all know that some relief bills are on the House's agenda but then given the actual time the Congress is going to be doing any legislative business, it is time to be prepared for the next presidency.
We can convey to both the campaigns that we are a 25000 strong �High Skilled Immigrants� advocacy group and can donate/campaign/put forward their case for them in this election.
A formal open letter to both the campaigns can be send as a start and then liaisons for immigration purposes can be contacted demanding their position about our issue.
I know that there is a stray mention of immigration related issues on the official website of both campaigns but if we can eke out something concrete regarding policy change and its implementation within a certain time frame after the elections it would be very helpful for our cause.

Wondering what the impact will be for 140 processing with the revised bulletin. Mine EB-2 has been pending in TSC for the last 5 months. It's my understanding we cannot use the AC-21 provisions like switching jobs without approved 140.
If 140 processing goes up to a year that would be really bad for new applicants. Atleast they should resume Premium processing. Any thoughts?

The H-1B system is clearly out-of-sync with the real world. Persons who qualify for �cap-subject� H-1Bs are allowed to apply starting April 1st each year, but can not start working until October 1st, six months later. Since the number of applications usually far exceeds the number of available visas, this means that by the second week of April, it is too late to apply. According to a FAQ on Murthy.com about the Yates memo, it is possible to switch jobs (using AC21) if 140 and 485 have both have been pending 180 days. Murthy doesn't advise this under normal circustances because if an RFE is received on the 140, then it is problematic if you've left the company.

WASHINGTON - California voters continue to disapprove of Congress even more than they do of President Bush, and for the first time Speaker Nancy Pelosi's ratings are more negative than positive, according to a Field Poll released today.
The poll found that 22 percent of state voters approve of Congress' job performance, with 64 percent disapproving. The discontent was bipartisan, with 70 percent of Republicans, 63 percent of independents and 58 percent of Democrats giving Congress negative marks.
Those findings, taken in a survey of 1,201 voters from Oct. 11 through Oct. 21, track national surveys. A Los Angeles Times/Bloomberg poll during the same period also found a 22 percent approval rating for Congress. A CBS Poll registered a 27 percent approval rating.
Bush earned a 27 percent approval rating from voters in the same Field Poll.
Political analysts give several reasons for the low marks: Democratic voters' dissatisfaction over the inability to change Iraq war policy, Republicans' opposition to Pelosi and other Democratic leaders, and a sense by many voters that Congress can't come to grips with tough issues such as immigration.
"Republican reaction has remained about the same this year, but the real trend is that rank-and-file Democrats and non-partisans are displeased because they expected more from the Democratic Congress," said Mark DiCamillo, director of the Field Poll.
Pelosi, a San Francisco Democrat, earned a 48 percent approval rating in March, two months after Democrats took over Congress. That dropped to 39 percent in August and 35 percent in October, with 40 percent disapproving and 25 percent registering no opinion.
"Iraq is the anchor weighing down Bush," DiCamillo said, "and now it's an anchor on Pelosi because of the complete inability of Congress to change course on the war."
Pelosi and other Democratic leaders held meetings in the last week to find ways to improve their "message" about what they call the New Direction Congress, highlighting such legislation as the minimum wage increase and ethics reform.
Despite the low marks for Congress, Republicans had little to cheer about in the new Field Poll. Voters gave an approval rating of 34 percent to Democrats in Congress, and 20 percent to Republicans.
Only 29 percent of Republican voters in California approved of the GOP performance in Congress, with 53 percent registering disapproval.
"That 2-to-1 disapproval by their own party really jumps out," DiCamillo said. "Republicans in Congress are now playing 'prevent defense' for Bush on the war and on domestic issues, and Republicans in this state do not approve of that."
The state's two senators, Democrats Dianne Feinstein and Barbara Boxer, earned higher marks than Pelosi and Congress overall, but the approval ratings for each senator dropped 10 percentage points since March.
The survey showed that 51 percent of all voters approved of Feinstein's job, with 31 percent disapproving. Boxer's approval rating was 44 percent positive and 35 percent negative.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. On Aug. 13, 2010, President Obama signed into law Public Law 111-230, which requires the submission of an additional $2000 for certain H-1B petitions and $2250 for certain L-1 petitions. Those who are subject to the additional fees include petitioners who employ 50 or more U.S. employees and more than 50 percent of its U.S. employees are in H-1B or L status (including L-1A, L-1B and L-2). For example, ABC company has 60 employees and has 35 employees in H-1B and L-1 status. ABC Company would be required to pay the additional fee for all new H-1B and L-1 petition filings. Extension of status petitions are not subject to the additional fee. The new fees are effective immediately, applying to all petitions submitted on or after Aug. 14, 2010 through Sept. 20, 2014.

I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?
